James specialises in commercial litigation and employment.
He acts in disputes between business owners, professional negligence claims, and property and insurance litigation. He has particular experience of complex disputes between shareholders in owner managed businesses. He is described in the Legal 500 as “bright and very good in cases with an overlap with employment”.
James is a solicitor advocate who has successfully represented clients in courts and tribunals around the country. He also regularly represents clients in mediations and negotiations.
A leading mediator endorsed James’ approach in mediations, stating “In a mediation a solicitor needs to keep a clear focus on the commercial realities while protecting the client’s position vigilantly. James manages to do this while deftly encouraging counter-parties to respond meaningfully to constructive proposals, which isn’t easy to do”.
Examples of James’s recent work includes:
- Representing a shareholder in an unfair prejudice petition and cross claim with a value in excess of £35m;
- Defending a telecommunications company against a claim by two directors and shareholders for £4.4m and a connected claim for constructive unfair dismissal following an abortive negotiation to purchase their shares.
- Defending a husband and wife against claims by their family that three of their London properties worth in excess of £1m were held on trust for the benefit those family members. James appeared as the advocate in three contested hearings in Royal Courts of Justice and in settlement meetings.
- Representing the former directors of an insolvent transport company against claims by the liquidator worth over £1m arising from alleged breaches of their duties as directors and the sale of intellectual property rights at an undervalue.
